Terms of Service

1.Subject matter and definitions

Powerpill provides a power bank rental service through automatic stations ("Totems" or "Stations") located across the territory, usable via the Powerpill app or directly at the Totem.

• Power bank: rechargeable portable battery with integrated cables, the object of the rental.
• Station / Totem: the vending unit from which the power bank is collected and to which it is returned.
• App: the Powerpill mobile application for iOS and Android.
• Rental: the period between the collection and the return of the power bank.
• Deposit: amount pre-authorized on the payment method to guarantee the return.

2.Requirements for use

To use the Service, the User must be at least 18 years of age, have a valid payment method and, for use via the app, register an account by providing truthful and up-to-date information. The User is responsible for safeguarding their credentials and for the activities carried out through their account.

3.How the rental works

The rental can be started in two ways:

• via the app, by scanning the QR code on the Totem;
• directly at the Totem, by tapping your card on the integrated contactless POS.

When the rental starts, the power bank is unlocked and made available. The User must check that it works correctly at the time of collection.

4.Rates and payments

Many Stations are free of charge; at paid Stations a time-based rate of €1.00 per hour applies, with a maximum cap of €3.00 per day. The applicable cost is always shown in the app before the rental starts.

Payment is made by credit or debit card, securely handled through the provider Stripe, or through the balance of the rechargeable in-app wallet. Where active, the subscription allows free rentals according to the conditions of the plan subscribed to.

5.Deposit and pre-authorization

When the rental starts, an amount of €15.00 is pre-authorized on the payment method as a deposit. This amount is not charged and is released upon the correct return of the power bank within the scheduled time. In the case of payment via wallet, the amount is temporarily deducted from the balance and re-credited upon return.

6.Return

The power bank can be returned to any Powerpill Station with a free slot, not necessarily the one where it was collected. The rental is considered concluded only upon confirmation of the return by the system. The User is responsible for the power bank until such confirmation and must make sure the return has been recorded before leaving.

7.Failure to return

After 45 hours from the start of the rental, the power bank is considered not returned. In such a case, the deposit amount (€15.00) will be charged as a penalty for failure to return. The amounts are always shown transparently before and during the rental.

8.User obligations and liability

• use the power bank properly and in accordance with its intended purpose;
• not tamper with, open, disassemble or damage the power bank or the Totem;
• keep the power bank with care and return it within the scheduled time;
• promptly report any malfunctions or damage.

The User is liable for damage caused to the power bank or the Totem through improper use, negligence or tampering.

9.Malfunctions and support

In the event of a malfunctioning power bank, the User may request support through the app or the contact channels indicated. Powerpill will endeavour to resolve the issue, including by unlocking a replacement power bank where possible.

10.Powerpill's liability

The power banks are certified and equipped with protections against overload and overheating. Powerpill does not guarantee the continuous availability of the Service or of power banks at a specific Station. To the extent permitted by law, Powerpill is not liable for indirect damages arising from the unavailability of the Service.

11.Right of withdrawal

As this is a service performed immediately and started at the express request of the User, once the rental has begun the right of withdrawal does not apply, pursuant to art. 59 of the Italian Consumer Code (Legislative Decree 206/2005).

12.Processing of personal data

The processing of the User's personal data is governed by the Privacy and Cookie Policy, which forms an integral part of these Terms.

13.Changes to the Terms

Powerpill reserves the right to amend these Terms. Changes will be made available through the app or the website and will apply to rentals following their publication.

14.Applicable law and jurisdiction

These Terms are governed by Italian law. For disputes with the consumer User, the court of the consumer's place of residence or domicile has exclusive jurisdiction, if located in Italy.
